General terms and Conditions of Sale – Belgium

  1. You have not booked your hotel

    Our hotel staff welcomes you to the hotel:

    Every day 24 hours a day.

  2. You want to book your hotel room

    1. Guaranteed booking

      Your booking is guaranteed as soon as you have pre-paid your stay (by cheque or in cash) directly with the hotel or communicated the details of your bank card when booking your stay (unless the bank details communicated are invalid). The communication of your bank card details to ensure your hotel booking does not authorise the hotelier to withdraw the payment for the nights booked, but authorises him to debit your account with the amount of the first night of the booked stay in the event of a no-show and if the hotel booking has not been properly cancelled.

In all cases of guaranteed booking, a booking number is communicated to you.
This booking number allows you to arrive at the hotel at the time of your choice.

    2. Simple booking

      Your booking will be simple when you book without communicating the details of your bank card :
      – either directly with the hotel for a stay in Belgium;
- or, when this is possible, on the website and/or via the B&B HOTELS mobile services for a stay in Belgium.
      In this case, the booking number that is communicated to you by the hotelier enables you to obtain a room.
      After 7pm, your room is automatically put up for sale again.

    3. Booking of event-driven and/or promotional offers

      These offers, only available on the website and/or via the B&B HOTELS mobile services, or on the websites and mobile services of B&B HOTELS’ trading partners, are exceptional rate offers for which no accumulation, no cancellation, no modification and no reimbursement are possible (including the rooms and any additional services).
      Unless otherwise indicated in the specific conditions of the offer, an online prepayment for the entire stay and for the additional services is required to confirm this booking.

  3. Booking procedure on the website and/or via the B&B HOTELS mobile services

    The booking procedure is as follows :
    1 : hotel search and choice of the room and of a rate ;
    2 : possible selection of additional services such as breakfast, except when the additional service is included in the rate mentioned under step 1 ;
    3 : verification of the detail of your booking, of its total price (including the possible tourist taxes), of the applicable sales conditions and possible adjustment to your choice (room, rate, additional service), then communication of your details;
    4: entry of the details of your bank card, consultation and express acceptation of the present general sales conditions, of the sales conditions of the booked rate and confirmation of the booking ; ;
5: B&B HOTELS acknowledges receipt of the booking by immediately sending an e-mail summarising the contract offer, the booked additional services, the prices, the sales conditions related to the selected stay and accepted by you, the booking date made, the Customer Service information, as well as the address of the hotel to which you can send your complaints.

  4. You want to cancel or change your booking

    You are reminded that, since it concerns accommodation services, in accordance with article VI.53, 12° of the Code of economic law, in principle you do not have the right of withdrawal set out in article VI.47 of the Code of economic law.

    By way of derogation to the above, simple and guaranteed bookings can be cancelled before 7pm on the expected day of your arrival.

    In the event of cancellation, you must warn the relevant hotel directly as quickly as possible.
• A cancellation number will be communicated to you.
    • It will confirm that your cancellation has been taken into account.

    The event-driven and/or promotional offers may not be modified, cancelled or reimbursed (whether it is for the amount and the arrangements of the stay or for the additional services), except if it is mentioned in the specific conditions of the offer.
    For any extension of your stay, you must imperatively enquire before 11am with the hotelier to know the availabilities. If this extension is possible, you must immediately pay for your room so that the hotelier can communicate you a new access code.

    If you are not within the hotel grounds in Belgium, you can also contact the hotel using the contact details set out on the website.
    For any interruption of the stay, it is imperative that you warn the hotel before 11am so that the interruption of your stay can be taken into account.
    Within the context of a guaranteed booking, the reimbursement of the price of the cancelled part of the stay will occur by the sending of a cheque corresponding to this amount.
    No reimbursement will be granted for an interruption within the context of a booking of an event-driven and/or promotional offer.

  5. No-show

    In the event of a no-show, any guaranteed booking:
• made by communication of your bank details and not cancelled before 7pm will automatically result in the invoicing and the debiting of the price of the first night as lump sum compensation and in the cancellation without any costs of the remainder of your stay. 
• made by prepayment with the hotel and uncancelled before 7pm, will result, upon your written request, in the reimbursement of the totality of your stay, after deduction of the price of the first night.

  6. Price

    The prices are indicated in euros, all taxes included, before and during the booking of the rooms. They are understood to mean per room for the number of person(s) and on the selected date.
The prices are confirmed to the customers in an amount including all taxes in euros, and are only valid for the duration indicated on the website.
Unless otherwise specified, the additional services (breakfast, parkings …) are not included in the price. 
The tourist tax, enlightened in step 3 of article 3, must be paid at the same time as the room. It is specified that, depending on the cities or countries, some taxes may be added to the rates.
The prices take into account the VAT applicable on the day of the booking and any change of the rate applicable to the VAT will automatically be echoed on the prices indicated at the invoice date.
Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be echoed on the prices indicated at the invoice date.

  7. Payment

    When it is executed online, the payment is executed by bank card (Visa, Mastercard, American Express) via a secure payment system. You will be asked for your bank card number, the cryptogram on the back of your card as well as its expiry date. Any payment that would be irregular, ineffective, incomplete or fraudulent for a reason attributable to you will result in the cancellation of the booking at your costs, without prejudice to B&B Hotels Belgium S.P.R.L.’s right to introduce any civil or penal proceeding against you.
Once your booking is confirmed and the full online payment is made, you will receive a detailed confirmation and a receipt of payment of your stay at the e-mail address that you have communicated us. The confirmation is deemed to represent the agreement of the parties. 
At your arrival at the hotel, you will be given a summary invoice for the total amount of your stay, including as the case may be the additional tourist tax that is due.
    Visa Electron and Maestro cards are not accepted to guarantee a booking, but can be accepted for your payment at the hotel. Payment by « e-carte bleue » is not available for the booking and the payment of your stay at B&B hotels.
    At the automatic reception booth, only bank cards with an electronic chip allow you to pay for your stay at B&B hotels.
    An invalid bank card results automatically in the cancellation of the booking.

  8. Complaints

    For a stay in Belgium, any complaint must be sent to the Customer Service of the company B&B Hotels Belgium S.P.R.L. via our contact form.
    Any dispute must, in order to be taken into account, be sent by e-mail via our contact form within a period of 8 days from your departure from the hotel, under penalty of foreclosure. In case of dispute, the data kept in our information systems have probative force. 

B&B Hotels Belgium S.P.R.L. and the hotels are insured for their professional liability with an insurance company known to be solvent.
    You must, furthermore, have taken care, during your stay, to report any disagreement so as to limit a possible damage.

  9. Liability

    The photographs and information shown on the website are not contractual.
    B&B HOTELS cannot be held liable for the non-performance or poor performance of the booking due to force majeure, due to a third party, due to you, due to a failure of the internet network or due to a payment refusal by the bank of the bank cardholder.

  10. Settlement of disputes

    In the event of complaints, the parties shall try to conciliate and to amicably settle their dispute.

    For the complaints relating to the bookings made online, you may also contact the Online Dispute Resolution Platform developed at European level in order to try to solve the dispute with B&B Hotels Belgium S.P.R.L. in an extra-judicial way :

  11. Stay at the hotel

    Unless expressly specified otherwise and without prejudice to provisions 2.1. and 2.2., room rentals go from 3pm on the first day of the booking to 12am on the last day of the booking.
    Animals are accepted at B&B against a surcharge as specified in the offer. The animal’s owner shall be held directly liable for any deterioration or damage caused by the animal. Depending on the applicable legislation, you may be requested to fill in a police form when you arrive at the hotel. To do this, you will be asked to present a form of identification in order to check whether or not you must fill out the police form.

    You agree and undertake to use the room in a reasonable manner and in accordance with its purpose. Also any behaviour contrary to normal behaviour and to public order will lead to the hotelier asking you to leave the hotel without any compensation and/or without any reimbursement if a payment has already been made, without prejudice to his right to introduce the appropriate penal and/or civil proceedings.

    B&B hotels provide a free WIFI access. You undertake not to use these computer resources for purposes of reproduction, representation, availability or communication to the public of any goods protected by copyright or a similar right without authorisation from the holders of these rights or in breach of their rights.

  12. Alternate accommodation and force majeure

    If the booked hotel is unavailable or in the event of force majeure, the hotel reserves the possibility to fully or partially accommodate you in a hotel of equivalent category for services of the same kind, the possible extra cost of the room and the transport between the two hotels being borne by the hotel initially booked, without prejudice to your right to refuse this proposal and to cancel your booking without any cost when the unavailability is not attributable to an event of force majeure.

    B&B Hotels Belgium S.P.R.L will not be liable in the event of non-performance of its obligations resulting from an event of force majeure. Cases of force majeure or fortuitous events are deemed to be the ones normally recognised by the jurisprudence.

  13. Privacy

    1. Processing of your personal data by B&B Hotels Belgium SPRL

      a) Legal basis: the processing of your personal data is based on the performance of the contractual obligations and on the pursuit of B&B Hotels Belgium SPRL’s legitimate interests (article 6.1. b) and article 6.1.f) of the general data protection Regulation (EU) 2016/679)
      b) Processing for purposes of customer management : B&B Hotels Belgium SPRL
      collects and processes your personal data (for example identification data, financial data, etc.) for purposes of customer management (such as, for example, for the customer administration, for the management of bookings, for the invoicing of the bookings and for the sending of personalised marketing and advertising).
      c) Specific consent to the processing for purposes of commercial prospection: provided you have given your explicit approval, B&B Hotels Belgium SPRL also processes your data (including your e-mail data) with a view to the profiling of purchases and the sending of commercial information. You may withdraw your consent at any time, by modifying the settings of your customer account and/or by freely sending an e-mail to the following address :
      e) Rights of access, rectification, erasure, objection and portability of the data : you have the right to access your data and may have them corrected if they are inaccurate or incomplete, to have them erased and limit the processing about you in accordance with the conditions set out in the law. Moreover, you have the right to receive your personal data in a structured format and to have them transferred to another company (right to the portability of your data). To exercise your rights, you may send freely the settings of your customer account and send freely an e-mail to the following address :
      f) Storage duration : your data will be stored
      o when they are processed for purposes of customer management : during the time necessary to perform the contract relating to the booking of the hotel and for a duration of one year from the end of the booked stay, except if their further retention is necessary to meet legal obligations (amongst others in the area of accountancy – 7 years).
      o when they are processed for purposes of commercial prospection : during a period of 1 year maximum from the end of the booked stay.
      g) Recourse : you have the right to lodge a complaint with the data protection Authority (Rue de la Presse, 35 at 1000 Brussels –

    2. Processing of your personal data by third parties and subcontractors:

      Third parties : B&B Hotels Belgium SPRL shall not be held liable for the processing of personal data by any third party (for example the online payment services provider) to whom you transmit your data. This processing is carried out under the liability of these third parties. For any request or question, you may contact directly the third parties in question.
      Transfer of your data: B&B Hotels Belgium SPRL uses subcontractors (for example IT infrastructures, servers) that process the personal data on instruction of and on behalf of B&B Hotels Belgium SPRL. Furthermore, B&B Hotels Belgium SPRL might also transfer your data to the other companies of the B&B Hotels Group that are established in the EEA. In any case, B&B Hotels Belgium SPRL commits to take the necessary measures to guarantee the security and the confidentiality of the data.

  14. Applicable law

    The present conditions are governed by Belgian law, without prejudice to the right of the consumers whose residence is located outside the Belgian territory to avail themselves of the mandatory provisions of their national law.

    Any dispute between the parties, not amicably resolved, will be under the exclusive jurisdiction of the Brussels courts, without prejudice to the consumers’ right to avail themselves of the provisions of Regulation (EU) n° 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.

These sales conditions are applicable from 18/05/2018, for up to 10 rooms booked and can be modified without any prior notification.

Bookings of more than 10 rooms are subject to a group contract.
